Canadian Immigration: Your Application Deserves More Than Form-Filling

Canadian immigration applications can appear straightforward. However, an answer that seems simple may affect eligibility, admissibility, credibility, family members, work history, finances, or future temporary and permanent resident applications. A complete application is not only about answering IRCC’s questions. It requires presenting accurate information, identifying legal issues early, and providing the evidence needed to support the application. Why Work With an Immigration Lawyer?   Immigration law often intersects with other areas of law, including family law, criminal inadmissibility, employment and corporate matters, and evidence. An omission, inconsistency, or misunderstanding can lead to delay, refusal, or complications in a future application. A lawyer does more than complete forms. We assess the legal requirements, advise on risks and available options, organize supporting evidence, and help ensure your application is accurate, complete, and consistent with Canadian immigration law and IRCC requirements. The responsibility for an immigration application ultimately remains with the applicant. Submitting only the minimum documents listed online may not be enough to establish eligibility or address concerns that arise from your personal circumstances. Start With Informed Legal Guidance   Professional legal assistance can help you identify and address issues before you apply, rather than after a refusal or procedural problem. We provide candid, practical, and ethical advice tailored to your immigration goals and circumstances. Whether you are applying to visit, study, work, reunite with family, or become a permanent resident of Canada, start with a clear plan. Estate Planning: Understanding the Basics

Estate planning is an essential process of managing your assets and finances for the future. It involves creating a plan that determines how your assets will be distributed after your death, ensuring that your loved ones receive their rightful inheritance without facing any legal battles or disputes. Here are some essential things you need to know about estate planning: Regardless of your age, income level, or the size of your assets, estate planning is a crucial aspect of life. It’s not only for the wealthy but for everyone who wants to ensure that their hard-earned assets go to the right people. While having a will is essential, estate planning is not just about drafting a will. It also involves creating trusts, power of attorney, health care directives, and beneficiary designations. These documents ensure that your estate is managed according to your wishes, even when you are unable to make decisions yourself. Probate is a legal process where the court distributes the deceased person’s estate. This process can be time-consuming, expensive, and emotionally draining for your loved ones. Estate planning allows you to avoid probate by creating a trust, which transfers your assets directly to your beneficiaries after your death. Estate planning protects your family from unnecessary legal battles and disputes. By having a clear and comprehensive estate plan, you can ensure that your loved ones receive their inheritance without any conflicts. Your estate plan is not a one-time thing. It should be reviewed and updated regularly to reflect any changes in your life, such as marriage, divorce, the birth of a child, or the death of a family member. Regular updates will ensure that your estate plan remains relevant and effective. In conclusion, estate planning is an essential process that everyone should undertake to ensure that their assets are distributed according to their wishes. By creating an estate plan, you can protect your family, avoid probate, and ensure that your hard-earned assets are distributed to the right people. Understanding Family Law: What You Need to Know

Family law is a broad and complex area of law that covers a variety of legal issues that families may face. These issues can range from marriage and divorce, child custody and support, spousal support, adoption, and more. If you’re dealing with a family law issue, it can be an emotional and stressful time, but understanding the basics of family law can help you navigate the legal system with confidence. Marriage and Divorce Marriage is a legal contract that can be entered into by two people. The terms of the contract can be customized to fit the needs of the couple, but most often include the division of property, spousal support, and child custody and support in the event of a divorce. Divorce is the legal process of dissolving a marriage. To file for divorce, one spouse must file a petition with the court. In most cases, the divorce process involves negotiations between the spouses and their lawyers to determine the terms of the divorce. If the spouses cannot reach an agreement, the court will make a decision for them. Child Custody and Support When parents separate or divorce, one of the most contentious issues can be child custody and support. Child custody refers to the legal rights and responsibilities of each parent regarding the care and upbringing of their children. Child support is the financial support paid by one parent to the other to help support the children. There are different types of child custody, including physical custody, which refers to where the child lives, and legal custody, which refers to the right to make important decisions regarding the child’s life, such as education and medical care. Child support is typically calculated based on the income of both parents and the needs of the child. Spousal Support Spousal support, also known as alimony or maintenance, is the financial support paid by one spouse to the other after a divorce. Spousal support is designed to help the recipient spouse maintain the standard of living they had during the marriage. The amount of spousal support can vary depending on several factors, including the length of the marriage, the income of each spouse, and the needs of the recipient spouse. Spousal support can be paid for a set period of time, or it can be paid for an indefinite period of time. Adoption Adoption is the legal process by which a person becomes the legal parent of a child who is not their biological child. Adoption can be a complex process, but it can provide a loving and stable home for a child who may not have had one otherwise. There are different types of adoption, including domestic adoption, international adoption, and step-parent adoption. Each type of adoption has its own requirements and procedures. Family law is a complex and emotional area of law that covers a variety of legal issues that families may face. If you’re dealing with a family law issue, it’s important to seek the advice of an experienced family law attorney who can help you understand your legal rights and options. With the right legal guidance, you can navigate the legal system with confidence and achieve the best possible outcome for you and your family. Canada announces extension of post-graduation work permits for up to 18 months to retain high-skilled talent

From: Immigration, Refugees and Citizenship Canada News release Foreign nationals with expired or expiring post-graduation work permits will qualify to work in Canada longer March 17, 2023—Toronto—Employers are facing unprecedented challenges in finding and retaining the workers they need during this period of economic recovery and growth. The Honourable Sean Fraser, Minister of Immigration, Refugees and Citizenship, today announced that international graduates with a recently expired or expiring post-graduation work permit (PGWP) will qualify for an additional or extended work permit to stay longer and gain additional work experience for up to 18 months. The PGWP Program allows international graduates to obtain an open work permit to gain valuable Canadian work experience. Starting April 6, 2023, these measures will allow PGWP holders who wish to stay longer to opt in to a facilitative process to extend their work permit and will allow Canada to retain high-skilled talent. Foreign nationals whose PGWP has already expired in 2023 and those who were eligible for the 2022 PGWP facilitative measure will also have the opportunity to apply for an additional 18-month work permit. Those with expired work permits will be able to restore their status, even if they are beyond the 90-day restoration period, and will receive an interim work authorization while awaiting processing of their new work permit application. Talented and skilled international graduates play a vital role in addressing Canada’s labour shortage, and those nearing the end of their PGWP are already well integrated into Canada’s labour market. The additional work permit will allow eligible applicants to continue contributing to the Canadian economy while gaining valuable work experience and preparing for the opportunity to apply for permanent residence. Quotes “We need to use every tool in our toolbox to support employers who continue to face challenges in hiring the workers they need to grow. At the same time, we’re providing international graduates whose work permit is expiring or has expired with some additional time to stay in Canada to gain valuable work experience and potentially qualify to become a permanent resident.” – The Honourable Sean Fraser, Minister of Immigration, Refugees and Citizenship Quick facts Reference: https://www.canada.ca/en/immigration-refugees-citizenship/news/2023/03/canada-announces-extension-of-post-graduation-work-permits-for-up-to-18-months-to-retain-high-skilled-talent.html At Prosperity Law, we provide approachable, practical legal support in Canadian immigration and citizenship, wills and estate planning, contracts, divorce and Alberta family law, corporate matters, and notary services. If you have a client, colleague, friend, or family member who needs legal assistance, please feel free to refer them to us.
